Dear Comrades,

The meeting of the Office bearers and/or DC Members of the affiliates was held on 21st December 2007 at the JCM Office, Brindavan, Anushakthi Nagar Mumbai. The meeting was presided by Com. S.K.Panchal. The meeting was attended office bearers of AEEA (RMP) Mysore, BARCFEA (BARC Facilities) Kalpakkam, GSOEA (GSO) Kalpakkam, HWEU (HWP) Tuticorine, HWP (M) EA (HWP) Manuguru, RAKU (HWP) Kota, CATSA (CAT) Indore, BPKS (HWP) Baroda, VECCSA (VECC) Kolkotta, DCS&EMSA (DCS&EM) Mumbai, AEW&SU (BARC) Mumbai. The meeting discussed the following agenda:

1. Review the out come of the 57th DAE Departmental Council meeting:
Com. S.K.Panchal, Member National Council (JCM) briefed the out come of the Departmental Council Meeting held on 20th December 2007. As decided in the pre DC meeting, the staff side leader submitted the resolution passed in the Pre-DC and requested to explain the present status of the issues discussed in the earlier Departmental Council meetings. Both staff side secretary and Leader staff side strongly express the protest of staff side against the delay and deny attitude of the DAE, especially the Chairman of the DC, in resolving the issues. They pointed out that rather resolving the issues, DAE management is always trying to complicate the issues. Other DC members also joined and supported the views expressed by the leaders of the staff side.
Finally the chairman agreed to meet a small group from the DC representatives to explain the present status of the issues listed in the resolution, as the same is not readily available. This meeting is fixed on 18th Jan. 2008. He also informed that there were some clarifications for 2nd Cadre Review Report from Ministry of Finance and same was clarified by the Department. He assured that all the quires were only in oral and need not to worry about any type of variations from the original proposal. He was expecting to give some positive reply before 20th December 2007. But they could not succeed. However the Chairman of DAE DC assured the house that he will try to get the result of 2nd CRR before 18th Jan 2008. There after Staff side agreed to discuss the agenda of DC. The copies of the letter written by the Federation to the Secretary DAE as well as the Resolution are attached herewith as Annexure I and Annexure II respectively.
The following points were discussed in Action Taken Report (ATR).
1. Changing the present working timing of Dombivli dispensary: The Head, Medical Division will find a suitable timing with out making over time to the staff at these dispensaries. This decision would be in consultation with the Mumbai based Union representatives.
2. Retainer fee to AMAs at Hyderabad: There are no AMAs at Mumbai as wrongly mentioned in the ATR, it was decided to have a look to review the retainer fee with consultation with the Head Medical Division, Mumbai.
3. Revision of Qualification Incentive Scheme (QIS): The comment from AO-III, RRCAAT was strongly opposed by the staff side and requested to revisit the issue. The same was agreed to.
4. PCA to Dental Technicians to HWP, Manuguru: It was decided to send a solid proposal to the concerned ministry.
5. Grant of Thermal Allowance to the employees: As the required material to make any counter argument to the points noted by the official side was not available, the staff side requested to keep the agenda alive and the same as agreed to.
6. Conversion of canteen into statutory canteens and retention of surplus staff: It was agreed to implement the report submitted by the canteen sub-committee. The chairman also asked the concerned officer to implement the orders regarding ACP.
7. Grant of risk allowance to the employees working in sewerage line, etc in GSO, Kalpakkam: A favorable decision in this regards would be taken before 18th Jan.2008. The staff side also agreed to the decision to go for fully mechanized solution.
8. Construction of more flats in Type - A accommodation: Finally it was decided to have meeting of the representatives from Mumbai based Unions with the Director, DCSEM to resolve this issue.
9. Technician’s promotion to next higher grades with higher qualification: The demand from the staff side to meet the TC/TSC to present the staff side to represent the views of our demands was not agreed to. But it was agreed to have frequent meetings with the Director/Controller to pursue the matter. Here the staff side pointed out that there was some misinterpretation of the guidelines in the published promotion norms and accordingly some track change promotions were handled wrongly. It was agreed to consider the same after receiving the representations from the individual.
Chairman, DAE DC accepted the corrections suggested by the Staff side in respect to the minutes of the 56th Departmental Council and agreed to give a copy of the corrected version of the minutes.
The following points are the out come of the discussion on Agenda:
1. Three additional increments to Administrative and Accounts Staff consequent on passing Departmental Examination: After detailed deliberations, it was decided to prepare a detailed proposal to send to the Finance Ministry after acquiring the required data.
2. Request for conducting departmental examination for the Post of Assistant Accountant (6500-200-10500): Notification for the same is being circulated and the exam shall be on 23-02-2008. It is also decided to submit the proposal from the staff side whether to keep the selection panel as unit wise or centralized one.
3. Implementation of Health Ministry’s Order with regard to Tradesman category (Dental Technician/ Dental Hygienist): The Chairman agreed the request from the staff side to replace the existing entry grade pay scale RS. 3200 – 4900 with Rs. 5000 – 150 – 8000 to Dental Technicians with reference to the order from the Health Ministry. It is decided to submit a proposal to norms committee to change the name and other nomenclature to suit with the order from Health Ministry of that category to Dental Technician “A” instead of Tradesman “B” and new pay scale of Rs. 5000 – 150 – 8000. Head, Medical Division is assigned the job to draft the proposal to submit the norms committee.
4. CPF to GPF – One more option for Technical staff: It is decided to collect the data to find the financial implication and accordingly the case may be reconsidered. The staff side also requested to consider the Administrative and Auxiliary staff also for the same.
5. Promotion chances for AMIE holders those who passed the examination before introduction of 60% benchmark: It is agreed to consider such case and asked to submit a representation of such case to Addl. Secretary. He will forward the same for a favorable consideration.
6. Cadre Examination & Result- Anomalies: It is agreed to conduct separate DPC for those two cases on 9th Jan 2008. It is also assured that such incident would not happen in future.

2. Briefing the decision of NFAEE Working Committee meeting held at Mysore & The National Council Meeting of Confederation of CG Employees & Workers held at Bangalore and the Standing Committee of National Council (JCM) meeting held at New Delhi:

Com. Jayaraj.K.V Secretary General NFAEE briefed the out come of the NFAEE Working Committee, National Executive Meeting of Confederation of CG Employees & Workers and the Standing Committee meeting of the National Council (JCM).

He briefed that the in the NFAEE Working Committee it was decided to protest against the Departments approach to suppress the trade union activities by initiating vindictive measure such as deduction of salary for participating in Dharana, Fast and other demonstration. Also to start campaign programme against the departments delay & deny attitude on various issues.

In the National Executive of Confederation of CG Employees & Workers, it was decided to hold protest programme against the Governments decision not to extend the enhancement of ceiling for eligibility for bonus from Rs. 2500 to 3500 and other important issues. The meeting decided following action programme:

· Badge wearing & mobilization of employees on 3rd January 2008.
· Relay Dharna from 7th January to 10th January 2008 followed by a March to Governor of concerned states to present Memorandum.
· Submit Memorandum to all MPs through the respective constituencies.

The meeting identified the following issues for immediate mobilization:

· Extend the revision of Ceiling limit for calculation of Bonus to the Central Government Employees.
· Remove cap of 5% on compassionate ground appointment.
· Implement all arbitration awards immediately
· Withdraw the arbitrary reduction of CGHS rates for hospitalization and pathological tests in recognized hospitals
· Regularize the daily rated workers

In the Standing Committee of National Council (JCM) meeting held on 14th December 2007, following issues came for discussion:

· Extend the revision of Ceiling limit for calculation of Bonus from Rs 2500/- to Rs 3500/- to the Central Government employees too.
· Extend Interim relief to the Central Government Employees
· Arbitrary reduction of CGHS rates for hospitalization and pathological tests in recognized hospitals
· Arbitration awards
· New Pension Scheme
· Compassionate Ground Appointments
· Retirement age

The copy of the letter issued by confederation head quarters contains the gist of the discussion in the meeting of the Standing Committee of National Council (JCM) is attached herewith as Annexure III.

3. Finalisation of Future Course of Action:

After detailed discussion the meeting took the following decisions:

1) Endorsed the action programme given by the Confederation of CG Employees & Workers and decided to organize the action programmes as mentioned above. Where ever COC of CG Employees and Workers are not function, there affiliates of NFAEE conduct Dharna on 10th January 2008. Wherever COC functions, there affiliates will join with COC programme of Dharna
2) Decided to conduct general meetings of employees in all units to explain the out come of the Departmental Council meeting and mobilize the members for action programme.
3) To show the protest of the employees against the Department’s vindictive measures to suppress the trade union rights organize protest demonstration on 26th January 2008. However this programme will finalise only after discussion in Joint Action Committees as well as the Executive/ Managing Committees before 4th January 2008.
4) To collect data, information etc before 18th January 2008 to present in the meeting of small group Meeting to review the issues.

4. Departmental Council (JCM) Functioning:

The meeting observed view lapses of the functioning of the Departmental Council. After discussion following steps suggested improving and activating the Staff side functioning of the DAE Departmental Council:

· Agenda shall be submitted through Secretary Staff side only. Agenda shall be addressed to the Secretary Staff Side. With covering note Secretary/Leader Staff side should submit to the Department for consideration. If necessary, Secretary Staff side shall write to the SRO to insist to accept the agenda with the covering letter from Secretary/Leader staff side.
· Agenda should be self explanatory, with detailed notes and added with the copies of the orders if any quoted in the brief.
· While submitting the agenda to Secretary Staff side, the same may be circulated to all Unions/associations for their comments or adding additional argument points through email. After circulation with five days comments should reach to the Secretary Staff side through email/ fax.
· In the Pre Departmental Council meeting the agenda items should be discussed in details and should assign a DC Member to move the agenda in the Departmental council Meeting. Other members can support him by adding additional argument points. No member should destruct the discussion or to try to by pass the agenda without proper decision. In this regard, they should follow the directives of the leaders of the Staff side in the meeting.
· Proper notice shall be issued for the staff side meeting. All staff side members should attend the staff side meeting in time.

Sub: Undue delay in the settlement in pending issues
pertaining to DAE employees.

Sir,

The Working Committee Members of NFAEE directed me to bring to your notice the concern expressed by the members in the recent past development towards the approach on pending issues as well as the attitude of the Department on bilateral discussion.

There are certain issues raised by the staff side pertaining to various categories of employees are pending with the Department as unsettled. Some of these problems are raised by the staff side almost ten years back. Following are some of the issues the staff side seeking immediate relief:

· Cadre Review of the administrative, accounts, auxiliary, purchase and store staff
· Revision of Over Time Allowance of employees of R&D and other establishments
· Revision of the entry grade Pay scale for Technical Staff as Rs 4000 – 6000 as recommended by 5th Central Pay Commission
· Add the increment for the period of Training to those technical staff appointed after the successful completion of Training programme.
· Framing Recruitment and promotion norms for Canteen Staff
· Review of the promotion norms of Technical, auxiliary staff etc
· Remove the cap of 5% ceiling on compassionate ground appointment
· Extension of Productivity Linked Bonus to all DAE employees
· Extending option to switch over from CPF to GPF for administrative, accounts, auxiliary, purchase and store staff
· Stop the victimization of Trade union activists
· Stop the vindictive measure to suppress the trade union rights by enforcing salary deduction for participating in the dharna and fast, issuing memo etc.
· Extending the facilities eligible for the Recognised associations and the Federation

The Department now a day adopted such an approach to avoid bilateral discussion at various levels. Meeting with Secretary DAE is become once in blue moon, that too as and when the staff side issues notice for action programme. Till recently, the same was compensated by arranging meeting at the level of Additional Secretary. But that too curtailed since Shri. R.C. Joshi becomes the Additional Secretary. Now the Additional Secretary meets the staff side only during the Departmental Council meetings. Also it becomes very rare to find any solution in the Departmental Council forum. Whenever approaching the office of Additional Secretary to meet him for follow up, which was the regular practice in the earlier occasions and gets results, never getting an appointment and directing to meet the Jt. Secretary (I&M). Thereafter the Jt. Secretary’s office directs to meet the Deputy Secretary and so on. By these approaches, no decisions have been taking on many of the issues. The staff side doesn’t have the intention to disturb the busy schedule of the Secretary or any other senior officers. Without meeting the top level officials, if the issues raised by the staff side are settled, we will be happier. But our experience in the last seven years is negative. Not a single major issues raised by the staff side after the implementation of the 5th Central Pay Commission is solved till date. The net result is nothing but the relation of employee – employer, maintained all these years, getting spoiled as issues are lying unsettled for years.

Even there are issues which can be sort out DAE level keeping on pending such as

· the proper implementation of the order issued by DoPT in the year 1997 to regulate Over Time Allowance based on the Notional pay
· Revision of the entry grade Pay scale for Technical Staff as Rs 4000 – 6000 as recommended by 5th Central Pay Commission
· Add the increment for the period of Training to the Technical Staff appointed after the successful completion of Training Programme
· Framing of recruitment and promotional norms for Canteen employees
· Reviewing the promotion norms of other Group D employees
· Remove the cap of 5% ceiling on compassionate ground appointment
· extending option to switch over from CPF to GPF
· Productivity Linked Bonus to all DAE Employees
· Extending facilities to the Federation
· Maintaining cordial relation between the management and the elected representatives of the workers etc. etc.

For the overall growth of the entire Department, the Working Committee feels a mentally satisfied work force is a must. Whereas the recent past developments in the Department to suppress the work force in all ways may reflect adversely in the growth of the department. A Department which looking foreword for the self reliance in its growth as well as development we feel strongly, that the management and the workforce should move together with a positive approach for which mutual respect and understanding is necessary.

To ensure the best employee – employer relation the Working Committee requests you to take necessary steps to ensure continuous bilateral discussion along with follow up actions and bring mutual trust for the betterment of the Department as well as the Nation. Also request you to take necessary steps to review the overall functions of various JCM fora such as Office Councils/Regional Councils functioning at the unit level and Departmental Council at DAE level

Dear Comrade,

Gist of discussions in the Standing Committee Meeting held today:

The meeting of the Standing Committee of the JCM National Council was held on 14th December 2007. Secretary (Personnel) presided. On behalf of the Confederation, Com. S.K.Vyas President and Com. KKN Kutty, Secretary General attended the meeting. All agenda items could not be discussed as the meeting had to be ended at 3.00 PM. The next meeting will take place within three months. Decisions taken on each of the agenda items discussed will be circulated shortly.

The following were the prominent issues that came up for discussion today:

(a) Bonus: Official side informed that the Cabinet had excluded the Central Govt. employees from the purview of the recent amendment to Bonus Act, whereby the ceiling limit for calculation of bonus had been raised from Rs. 2500 to Rs. 3500. The Staff Side reacted sharply to this statement and informed the Secretary Personnel that they would be left with no alternative but to withdraw from the discussion forum and resort to action programmes if the Govt. persists with its untenable decision. The Secretary (Personnel) assured the Staff Side that he would convey their strong resentment over this issue to the Cabinet Secretary and will convey the Government's position. The Staff side has decided to meet in the first week of January, 2008 and consider the outcome of efforts of the Secretary Personnel in this regard and take appropriate decision.

(b) Interim Relief and the CPC Report: The Staff Side Secretary conveyed in his initial remarks that the employees are concerned over the delay in the submission of the report by the 6 th CPC due to the various references being made by the Govt. at the last minute. He also informed the Secretary Personnel that most of the Public Sector undertaking employees have been granted interim relief ranging from Rs. 20000 to Rs. 60000 while the Central Govt. employees are denied despite specific terms of reference to the 6 th CPC. He urged the Secretary Personnel to appreciate the injustice caused to the Central Govt. employees in this regard.

(c) Arbitrary reduction of CGHS rates for hospitalization and pathological tests in recognized hospitals: The Stand of the Health Ministry officials was that the rates had been revised on the basis of the tender and naturally the recognized hospitals were not entitled to object to it. The Staff Side pointed out that none of the recognized hospitals had entered into an MOU with the Govt. on the reduced rates and the beneficiaries are denied the treatment in all places. After some discussions it was decided that:

(i). the Health Ministry officials will interact with the CGE organizations in all Cites and towns where the scheme is in vogue and report as to which hospitals are providing treatment on the basis of the reduced rates and which of them were refusing to take corrective steps;

(ii). The calendar of such meetings pertaining to various CGHS centres would be prepared by the Health Ministry and would be submitted to the Secretary (Per) within 10 days.

(c) Arbitration awards: It was indicated that discussions on all items had been completed and the matter is being considered at the level of the Cabinet Secretary as to the next course of action.

(d) New Pension scheme: Both the Sides reiterated their position. The denial of family pension and other retirement benefits in respect of the employees recruited after 1.4.2004 and the remedial actions were stated to be under consideration of the Govt. In respect of those employees who were given the temporary status prior to 1.4.2004 and in whose cases, 50% of the services rendered as casual/contingent/daily rated workers are to be counted for the purpose of pension, the Secretary Pension informed the staff side that the question of treating them as having been recruited prior to 1.4. 2004 would be considered.

(e) Compassionate appointments: The Official side has gone back on their earlier assurance and has now stated that no further relaxation would be available in this regard further to what had been already announced. The Staff side contested the position taken by the Department of Personnel in the matter and reminded them of the promise held by the Cabinet Secretary when the issue was discussed with him as part of the strike charter. The continuing discrimination in the matter of compassionate appointment between the employees of the Railways and other Central Govt. employees was also brought home. After discussion, it was decided that the Joint Secretary (E) in the Department of Personnel will discuss the issue once again with the staff Side to prepare a note to the Cabinet Secretary incorporating the views of the staff side properly for his reconsideration.

(f) Retirement age: At the end of the meeting Staff Side Secretary enquired whether there was any proposal to rise the retirement age from 60 to 62 to which the Secretary Personnel clarified that to the best of his knowledge and information that neither the Department of Personnel nor the Finance has officially mooted any such proposal.
